General Disability Law

Royal Legislative Decree 1/2013, of November 29, approving the Consolidated Text of the General Law on the rights of people with disabilities and their social inclusion.

All Spanish companies with a workforce of 50 or more workers (total workforce regardless of the hiring modality) are obliged to reserve 2% of it to people with a recognized disability equal to or greater than 33%.

It is also possible to take advantage of the alternative measures of direct hiring of people with disabilities through any of the following options:

  • Contract with a self-employed with a disability or a special employment center the supply of raw materials, machinery, capital goods, etc.
  • Contract with a self-employed with a disability or a special employment center services outside and accessories to the main activity of the company.
  • Make donations to non-profit organizations whose objective is the social integration of people with disabilities.
  • The constitution of a labor enclave.

The special employment centers have shown throughout their history that they can operate in the business environment in very advantageous conditions for companies both socially and economically. They are an ideal tool to combine business management and corporate social responsibility.

Those companies, both public and private, that fail to comply with the provisions of the General Law on the rights of people with disabilities and their social inclusion, in terms of the reservation quota for jobs, may be sanctioned with a fine of between € 301 and 1,000,000 € depending on the severity and graduation of the breach.
